View Full Version : Getting a visit from the ATF.

I'm scheduled May 7th for the compliance visit from the ATF. He said he will be basically checking to see that there is in fact a building at the address listed on my FFL and that it is displayed (on wall above my bench). More or less hinted that he has better things to do than check out an ammo manufacturer. He'll be in the area for a few weeks checking the FFLs and such in the UP.

Sorta nervous as this time is the first in person interaction with the ATF, but I got all my **** together, so there shouldn't be any issues. I don't have tax issues that the ATF needs to be made aware of. Just a few questions about the procedure for reapplying for the FFL as a corporation.

Don't know if I have to do the whole thing or just submit a letter of intent basically explaining that I am currently licensed as an individual, but now I'm incorporating and am getting the corporation licensed, FFL copies, and that's it. Hopefully I won't have to get mugged and printed again or have another compliance visit as it is essentially the same thing, just different name.

Going to drill him about the 07 FFL. I don't know if he has power of arrest, but I'll have to inform him of my carry status per state law.

Don't get too worried. Most of these guys wait to see how you treat them before they decide how they will treat you. Get off on the right foot and I bet all will be well. Let us know how it goes.

If like the normal inspection, his interest will be tilted toward any required record-keeping.

He did the compliance over the phone when I got my license in January. The field office is in Grand Rapids, close to 12+ hours away. Rather than make me wait, he just did the compliance on the phone with a premises visit within 12 months.

He said for an ammo manufacturer, there is no record keeping required so he basically spent 10 minutes on the phone with me:


stating the age requirements for ammunition and bullet purchases are the same for firearms
if I sell loaded ammo, there is excise tax due
to contact the Tax and Trade Bureau for details, as with the restructuring of the ATF, they can't give info out about that
said he's mailing my license and a phone number list for all the departments in the ATF
Business with the US government? They lose 6 billion in cash last year and I am supposed to count on prompt payment?:sifone:

Hey Freak,

Last summer I has a state sales tax audit. First time in 29 years. I run a tight ship, but was still nervous of what to expect. I did some research before the auditor came, and I was told first impression was important. I made sure the office was organized, the area he was going to work at was clean & organized and that all the docs. and reports he requested were at his fingertips before he even started. My accountant told me it will cost me 5-7K just to justify his coming out and doing his job. Cost me under 500 bucks after 3 days of review. (The cleaning service I use to clean the office didn't charge me sales tax which I had to pay and some software and reference books I use in business that I purchaed on the I-net that I didn't pay sales tax on. Both of these fall into the "use tax" catagory).

I know your deal isn't an audit, but still a govt. review of sort. I think being organized and starting off on the right foot is the key. The auditor was a decent fellow, and treated me well and respectfully.

Wife will be at work. I will be at home with my son. Possible babysitter arrangements can be made for a short time, maybe.

The only paperwork he is concerned with is my FFL, which is signed and properly displayed on the premises. I have no other paperwork. He probably won't even shut the vehicle off.

Have a neighbor take pictures of the interior BEFORE the inspection. Email them to everyone you know...

As an "X" ISO 9000 auditor........I can tell you be prepared and don't try to blow any smoke. I could tell right away when someone was trying to hide things from me which made me only dig further into the area of concern. Be Cool !

When I had my FFL the ATF were always a pleasure to deal with. There concern is you keeping all the required records and obeying all the rules. Any questions and there more than happy to help.

They want to make sure everything is nice and legal.

MI's requirement to disclose does NOT apply in your home or place of business. You are NOT required to have a CPL to carry on your own property, therefore, you do not need to disclose.

Funny, they are an hour from my shop and I haven't heard from them yet.

I don't have much to show though. The machine was in buckets for much of the time I have had the license. I won't sell like mad until June.

Isn't your cleaning service a "labor" only type thing?

In North Carolina, you can't charge sales tax on labor.

He's making ammo, not starting his own religion. He should be fine. The ATF has jurisdiction over all people starting their own religions you know.:rolleyes5:

I'm referencing the ATF invading the home of a reserve cop, trashing it, stomping his dog to death, kicking his wife down the stairs causing a miscarriage, and then spreading his collection all over the house, photographing it out of context, and making him out to be something he wasn't.

He wasn't starting his own religion. He just wanted his legally possessed machinegun back.

As with any audit, have the work space neat, clean, and organized. Have any necessary documentation organized and available. When asked something, concisely answer only the question asked. Don't add additional information. Be courteous, briefly answer, and then shut up! More people get in trouble by continuing to talk well past the intent of the question.

I have heard a lot of good things about this book. I would like to pick it up sometime. Maybe the second part of the summer when my class is over I will have time to read something other than lab manuals and textbooks. I am pretty pumped though, I have a class for the first part of the summer and that is it for me. No more summer courses until I am out of school.

Sorry for the late response. Wasn't near the computer the last couple of days. No, the cleaning service falls into the "sales and use tax" category. So, in MN if you use a service or labor or anything in a business, it's taxable. My question was why didn't they go after the cleaning service, who failed to collect the tax?. My accountant said, They'll be put on the audit list. So they collected the tax from me and will again (plus penalties) from the cleaning service. The old "double dip".

First night with my new sports car, I got pulled over (speeding) by a female deputy sherrif. This woman looked like Carmen Electra dressed up as a cop! Seriously, she was very attractive and I almost thought that this was someone playing a joke on me. I didn't say anything stupid. Good thing too because it wasn't a joke and in about 10 seconds another officer showed up for "backup" purposes. I figure if I had so much as sneezed that guy would have shot me, just to get a date with the deputy chick.

I got a warning and was on my way.
