A North Texas homeowner shot and killed a 17-year-old, who police say broke into an Oak Cliff house. The shooting happened around 11am in the 300 block of Hobson.
"It was a matter of life and death," explained Charles Bircher. The homeowner said he doesn't always carry his gun, but is glad he had it Wednesday. Bircher claims the teenager, "was trying to kill me."

According to police, it was Gabriel Flores who kicked in the door of the house Bircher shares with his mother, Ivy Willis. "These people don't work and just want to break in and take what everyone else got," she said. There was no one home when Flores initially entered the house, but soon after Bircher arrived home and confronted the burglar. Flores had stolen a gun from inside the home and used it against Bircher, but the homeowner has a concealed handgun license and was carrying a weapon.
"He shot at me four or five times and thank goodness he missed," explained Bircher. "I got off one or two rounds and I guess I hit him."

Flores was pronounced dead at a local hospital.

Seventy-nine year old Ivy Willis arrived home a few hours after the incident and said she's relieved her son protected himself. "I would've done the same thing."
Dallas police will refer the case to a grand jury, which will decide if charges should be filed against the homeowner.

This doesn't make sense to me. Why waste the grand jury and legal system's time and money.

No kidding... this doesn't deserve anything more than a dozen roses sent to this guy for voluntary sewage removal. I thought Texas was supposed to be all gun friendly, and stuff???!!! That story is outrageous... shootin' at the dude with his own guns after breaking in. He should move to Florida where we can shoot without a need for retreat!

There's no need for retreat here either. It seems kinda strange that the case would be refered to the grand jury, maybe just protocol. Theres no way this guy will have charges filed against him, unless theres something not printed in the story.

Glad he was carrying that day! Bet he does everyday from here on out.

If there were child proof locks on the guns in that house that poor 17 year old kid wouldn't have made the homeowner defend himself; therefore it is the homeowner's fault. He prolly planned the whole thing.

Leaning left is part of it. I heard he may have chased the kid out into the street when the shootout happened. No worries if kid drew/fired first, but that's prolly what they want to look at if I had ta guess.

Dunno about Texas, but we ALWAYS submitted any citizen shooting to the District Attorney's Office for review. Mostly, it's pro forma and largely kabuki theater to settle down whatever predator cheerleading occurs after the fact. Grand Jury indictments are rare in CA state courts, they are used by prosecutors here to do "The Pontius Pilate Routine" ('I wash my hands of this matter') when a decision to charge someone might be highly charged, politically or socially.

Being a burglar is a tough job.
